Today we sent a text message to all of our patients (with mobile numbers attached to their records) advising that on our website and Facebook page there was a letter from Daventry District Council asking for comments to the application.
We wish to offer an apology to anyone who feels we have broken GDPR rules by making this contact
The two articles of the GDPR below are the ones that apply in this case
Article 6 e Public Task: The processing is necessary to perform a task in the public interest or for official functions and the task or function has clear basis in law.
Article 9 h….for the purposes of preventative or occupation medicine for the assessment of working capacity of the employee, medical diagnosis, the provision of health or social care or treatment of the management of health or social care services
With feedback and consideration we believe the practice has made an error for which we apologise and we have reported the breach to our Data Protection Officer and through the NHS DS&P toolkit, the toolkit stated the breach did not meet the threshold for reporting to the Information Commissioner, but we decided as a practice that we would still report ourselves.
The text was sent in good faith and we honestly believed the text supported the provision of healthcare, without a new surgery your future healthcare could be jeapardised.
